AGREEMENT

The term “member/student” used in this Agreement means either the parent/guardian signing this Agreement or the Student who is an adult member, wherever applicable.  The words "I, you, and your” shall also mean member.  The terms “we, our, and us” shall refer to the school U.S. Jow Ga Martial Arts, its coaches, staff and/or members.

School Rules:

  1. Students shall show respect for the training area with a "traditional bow" as they enter and leave through the entrance.
  2. Students are expected to push themselves, but it is important to do so correctly to avoid injury. In the case of joint sprains, muscle strains and other injuries; our approach is to see the instructor right away, and if you are willing to continue, avoid all exercises which aggravate an injury. However, it is often wise to pursue with increased vigor those techniques which do not aggravate the injury. Your overall fitness has a great influence on your body's healing powers.
  3. Humility is a very important characteristic of the martial artist. Show respect to others, regardless of their ability, age, or gender. Students shall show respect to senior students and show respect to your instructor. Address all by their title in relation to you.
  4. Appropriate posture when watching other students review forms, or when not practicing, is as follows: feet shoulder width apart, back straight, hands clasped at waist behind back or in front (especially when weapons are being used). "Lounging" or postures with crossed arms or hands on hips are considered rude and inappropriate.
  5. Kung Fu requires quiet for maximum concentration. When classes are in session, visitors, as well as students shall respect the quietness of the setting.
  6. Aggressive behavior or cursing is grounds for expulsion. Conflicts of the outside world shall remain outside. When you enter the training area, you are there to learn. We believe you shall "avoid conflict, and do not seek it out."
  7. During all drills and form reviews, students shall line up according to seniority. However, slower students shall respect the right of others that go faster. Students shall not crowd each other during drills.
  8. Students shall not try to learn or practice new movements without proper instruction. Students are forbidden from teaching forms or self-defense moves, formally or informally, to non-students.
  9. Students shall not use weapons in which they have not yet received training. Do not use any weapons when children are present on the floor. Use only practice weapons (non-edged), and exercise extreme caution when using weapons as a group. Unsupervised weapon sparring is not permitted. Students shall not use training equipment without proper instruction from the instructor or an appointed senior student.
  10. Students may not enter any martial competition (forms or fighting) without expressed consent from the staff.
  11. Student uniforms (school shirt, black pants and appropriate shoes) are required in all classes and shall be kept clean. 
  12. Respect our building, our training hall and our equipment; keep them clean and free from damage. Students are required to clean the school before and after class.
  13.  Students shall not remove any item, equipment or other property of the school without permission from instructors.
  14. Children shall not be left unsupervised anywhere in the school even while a parent is attending class.

Student represents that he/she is in good physical condition and has no medical illness or condition that would inhibit his/her ability to participate in martial arts and exercise programs made available by the  U.S. Jow Ga Martial Arts, its coaches, staff and/or members. We suggest you consult a physician before starting this exercise program. 

Student fully understands and agrees that by using the facilities, participating in the martial arts programs, or representing the  U.S. Jow Ga Martial Arts, its coaches, staff and/or members in activities or competitions, whether or not within the facilities, there are possibilities of physical and/or accidental injuries.  Student will not hold us responsible for any and all injuries or accidents.

Student voluntarily agrees NOT to hold responsible the  U.S. Jow Ga Martial Arts, its coaches, staff and/or members, its owners, officers, employees, assistants, and related members for any and all injuries or accidents that may occur during ANY activity within or outside the facilities.

Student understands that it is his/her responsibility to obtain insurance coverage including but not limited to medical, disability, and/or life insurance.

Student agrees to follow all the rules and regulations of the  U.S. Jow Ga Martial Arts, its coaches, staff and/or members and will forfeit enrollment/membership without refund by failing to do so.

We strongly recommend the use of protective equipment during training to reduce the possibility of accident or injury; however, the use of certain protective equipment is mandatory.  The student understands that it is his/her responsibility to use or wear protective equipment. 

Student agrees that he/she is responsible for any and all liability incurred by any person brought or invited into the facility by the student.  Student is advised to avoid bringing valuables into the facility, and under no circumstances will the  U.S. Jow Ga Martial Arts, its coaches, staff and/or members be liable for any damage or loss of personal property belonging to student or guest.

The  U.S. Jow Ga Martial Arts, its coaches, staff and/or members admits students of any race, color, national, and ethnic origin to all the rights privileges, programs, and activities generally accorded or made available to students at the school.

Student understands that payment for tuition or any item is non-refundable even if student does not attend class for an entire month. Student understands that a minimum attendance of one class constitutes monthly attendance.

Student understands that classes may be unavoidably cancelled for bad weather school events, unavoidable circumstances or unscheduled building maintenance.


Photo/Video Release

I grant permission to U.S. Jow Ga Martial Arts, its coaches, staff and members the irrevocable and unrestricted right to reproduce the photographs and/or video images taken of me, or members of my family, for the purpose of publication, promotion, illustration, advertising, or trade, in any manner or in any medium.

I hereby release U.S. Jow Ga Martial Arts, its coaches, staff and members for all claims and liability relating to said images or video.

I grant U.S. Jow Ga Martial Arts, its coaches, staff and members permission to use my statements that were given during any interview or guest lecture, with or without my name, for the purpose of advertising and publicity without restriction. I waive my right to any compensation.


COVID-19 ACKNOWLEDGMENT AND DISCLOSURE

I understand that during this COVID-19 Public Health Emergency I will NOT be permitted to enter the facility beyond the designated drop-off and pick-up area unless I am a U.S. Jow Ga Martial Arts student and taking the current class.  I understand that this procedure change is for the safety of all persons present in the facility and to limit to the extent possible everyone’s risk of exposure. 

 I understand that IF there is an emergency requiring me to enter the facility beyond the designated drop-off and pick-up area, I MUST sanitize my hands before entering, remove my shoes and wear a mask.  While in the facility I must practice social distancing and remain 6ft from all other people, except for my own child. 

I understand that to enter the school premises temperatures will be taken. I and my child must be free from COVID-19 symptoms.  If, during the day, any of the following symptoms appear, my child will be separated from the rest of the people in the school.  I will be contacted, and my child MUST be picked up from the school within 15 minutes.

Symptoms include,

·  fever of 100.4 degrees Fahrenheit or higher

·  dry cough

·  Shortness of Breath

·  Chills

·  Loss of taste or smell

·  Sore Throat

·  Muscle aches

While many of these symptoms might be non-COVID-19 symptoms we are proceeding with by assuming they are Covid-19 during this Public Health Emergency.  These symptoms typically appear 2-7 days after being infected so please take them seriously.  You will need to be symptom free for 72 hours before returning to the facility.

 I understand that I and/or my child must always wear a mask while in the school and on school premises.

I understand that students will be required to bring their own hand sanitizer and use it according to CDC recommended handwashing procedures every time they touch a surface in the school.

 Each student MUST remove their shoes at the entrance of the facility.  Those shoes will be put into a “dirty bag” and placed inside their personal gear bag. Students have the option of leaving a pre sanitized pair of shoes at the school for class purposes or can have their shoes sanitized upon entering the premises.

 I understand that outside of martial arts, all students will comply with all state, county or local stay-at-home orders, and all contact with persons living outside our household will follow all state, county or local stay-at-home orders.  My student and our family will comply with any and all state, county or local stay-at-home orders, will limit contact outside of the school to persons living in our household and will only go out to inside venues in which we can maintain a minimum 6 foot social distancing.  I will follow any recommendations from the CDC that limits my risk for exposure including wearing a mask in all public areas and remaining 6ft from all other people.

 I will immediately notify U.S. Jow Ga Martial Arts management if I become aware of any person with whom my child or I have had contact exhibits any of the symptoms listed in [STATEMENT 1] above, is advised to self-isolate, quarantine, or has tested positive, or is presumed positive for COVID-19.  Further, I will immediately notify U.S. Jow Ga Martial Arts management if anyone from my place of employment is presumed positive or tests positive for COVID-19 whether or not I have had direct contact with that person.

 I understand that Students entering our school will be in contact with children, families and  employees who are also at risk of community exposure.  I understand that no list of restrictions, guidelines or practices will remove 100% of the risk of exposure to COVID-19 as the virus can be transmitted by persons who are asymptomatic and before some people show signs of infection.  I understand that I play a crucial role in keeping everyone in the facility safe and reducing the risk of exposure by following the practices outlined herein.

 I  certify that I have read, understand, and agree to comply with the provisions listed herein.  I acknowledge that failure to act in accordance with the provisions listed herein, or with any other policy or procedure outlined by U.S. Jow Ga Martial Arts will result in disciplinary action up to and including termination of membership without refunds.  I acknowledge that my membership will be terminated without refund if it is determined that my actions, or lack of action unnecessarily exposes another student, their family member, or instructor to COVID-19.


This agreement constitutes the sole and entire agreement between U.S. Jow Ga Martial Arts, its coaches, staff and members and myself in regards to the personal training program described above. No other agreement exists between us, and U.S. Jow Ga Martial Arts, its coaches, staff and members have made no representations to me, verbally or in writing, about such personal training program except as stated herein.

The purpose of this document is to bring your attention to the existence of potential dangers associated with participation in this class and to aid you in making a voluntary and informed decision as to whether you (or your child or ward) should participate in this class or activity.  As a student or a parent/guardian of a student, it is your responsibility to learn about and/or to inquire of teachers, physicians, attorneys or other knowledgeable persons about any concerns that you might have at any time regarding student safety and the safety of this activity.  You may seek legal counsel before signing this form.  If you decide to participate, by your signature you hereby agree to indemnify and hold harmless U.S. Jow Ga Martial Arts, its coaches, staff and/or members against any/all claims, damages, demands, liabilities and costs incurred including attorney's fees, which might be made by the undersigned or any third party as a result of damage, injury or death suffered.  This agreement shall be binding upon the heirs, successors and assigns of the undersigned. 


STUDENT/CLIENT:  I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ AND DO UNDERSTAND THE ABOVE INFORMATION AND WARNINGS OF RISKS. I ALSO UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I LIMIT MY LEGAL RIGHTS AND AS SUCH, I HAVE BEEN ENCOURAGED TO SEEK LEGAL COUNCEL BEFORE SIGNING.

PARENT/LEGAL GURDIAN (if student is under 18 years of age):  I have read the above WARNINGS and I understand that this class may potentially involve the RISK OF INJURY OR DEATH and that by permitting my child/ward to participate in this class they may be subject to the possibility of injury or death.  I acknowledge that I do understand the contents of this form and I voluntarily choose to permit my child/ward to participate and by my signature do hereby release, indemnify and hold the college, its officers, employees and agents harmless from any claims, damages, demands, liabilities and costs incurred including attorney’s fees.  I understand and acknowledge that I have been encouraged to seek legal counsel before signing this document and that by signing this form I am severely limiting my legal rights.  A complete copy of this form will be provided to me upon request.
