Release and Waiver of Liability and Indemnity Agreement(Read Carefully Before Signing)In consideration of being permitted to participate in any way in the Legacy Filipino Martial Arts Program indicated below and/or being permitted to enter for any purpose any restricted area (here in defined as any area wherein admittance to the general public is prohibited), the parent(s) and/or legal guardian(s) of the minor participant named below agree:1. The parent(s) and/or legal guardian(s) will instruct the minor participant that prior to participating in the below Legacy Filipino Martial Arts activity or event, he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise the officials of such condition and refuse to participate. I understand and agreed that, if at any time, I feel anything to be UNSAFE, I will immediately take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.2. I/WE fully understand and acknowledge that:(a) There are risks and dangers associated with participation in Legacy Filipino Martial Arts events and activities which could result in bodily injury, partial and/or total disability, paralysis and death.(b) The social and economic losses and/or damages, which could result from these risks and dangers described above, could be severe.(c) These risks and dangers may be caused by the action, inaction or negligence of the participant or the action, inaction or negligence of others, including, but not limited to, the Releasees named below.(d) There may be other risks not known to us or are not reasonably foreseeable at his time.3. I/WE accept and assume such risks and responsibility for the losses and/or damages following such injury, disability,paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releasees named below.4. I/WE HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the_Legacy Filipino Martial Arts facility used by the participant , including its owners, managers, promoters, lessees of premises used to conduct the Legacy Filipino Martial Arts event or program, premises and event inspectors, underwriters, consultants and others who give recommendations, directions, or instructions to engage in risk evaluation or loss control activities regarding the Legacy Filipino Martial Arts facility or events held at such facility and each of them, their directors, officers, agents, employees, all for the purposes herein referred to as “Releasee”...FROM ALL LIABILITY TO THE UNDERSIGNED, my/our personal representatives, assigns, executors, heirs and next to kin FOR ANY AND ALL CLAIMS,DEMANDS, LOSSES OR DAMAGES AND ANY CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY,INCLUDING BUT NOT LIMITED TO THE DEATH OF THE PARTICIPANT OR DAMAGE TO PROPERTY, ARISING OUT OF OR RELATING TO THE EVENT(S) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.5. I/WE HEREBY acknowledge that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED also expressly acknowledges thatINJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OFTHE RELEASEES.6. If, despite this release, the participant makes a claim against any of theReleasees, the parent(s) and/or legal guardian(s) will reimburse the Releasee for any money which they have paid to the participant, or on his behalf, and hold them harmless.I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.


Permission for photography/video for valuable consideration received, I grant to Legacy Filipino Martial Arts the absolute and irrevocable right and unrestricted permission concerning any photographs that he/she has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if he/she so chooses. I release and discharge Photographer from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom he/she took the photographs. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.



ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY (COVID-19)

I understand and acknowledge that COVID-19 is a global pandemic. On March 13, 2020, the President of the United States declared that the outbreak of COVID-19 in the United States constitutes a national emergency. The President has since allowed gyms and martial arts studios to re-open in phase 3 with certain guidelines. The Governor of the State of California has also declared that gyms and martial arts studios may reopen as of June 15, 2020. I understand and acknowledge that COVID-19 is a public health risk, and Eskabo Daan Filipino Martial Arts LLC, and their owners, operators, association

leaders, instructors, landlord and other participants cannot guarantee my safety or immunity from infection. There is no known vaccination for COVID-19. The mode by which COVID-19 is transmitted or how long it remains on surfaces is not entirely known. With full appreciation of these facts, I voluntarily agree to participate in the classes. In consideration for my participation, I knowingly and voluntarily assume all risks associated with my practice/training, including but not limited to, the risk of illness, death, bodily injury, disability, or exposure or infection with COVID-19. With full understanding of the aforementioned risks, I knowingly and voluntarily waive and release the above stated parties from all present and future claims of any type for any harm or loss, including but not limited to, economic loss, personal injury, disease, death, or property damage suffered by me during my practicum/internship. I agree to indemnify, hold harmless, and covenant not to sue any of the above for any personal injury, death, medical expenses, disability, loss of capacity, property damage, court costs, attorney’s fees, or other loss arising out of my participation.

By my signature below, I certify that have read and fully understand this waiver and
release and understand that it affects my legal rights. I understand and acknowledge that this waiver and release shall be binding on me, my heirs, family, estate, representatives, and assigns.

I acknowledge that I am aware of and agree to abide by the following safety guidelines:
· Before entering the building: Students will be subject to have temperature taken (Must be under 100.4). Hand sanitizer will be applied. All students under 18 must be signed in by parents at the door.
· No large bags of equipment. Bring gloves & sticks only.
· Social distancing of 6 feet required. No physical contact at all between students.
· Drinking fountains will be closed to students and spectators.
· Masks are mandatory.
. Floors and areas will be mopped and wiped down after every class.

PRINCIPLES 

Principles are self-evident and — as part of most traditions and philosophies over the ages — they’ve been woven into the fabric of societies throughout human history. They often concern human behavior and govern interactions between people.


  • We foster a culture of respect and safe training space. 

  • We are positive role models of behavior at all times.

  • We welcome and support everyone who strives to learn.  

  • We exercise proper sportsmanship. This includes refraining from the use of derogatory terms in relation to race, religion, sexual orientation and/or gender expression.

  • We refrain from any activity that could be considered as bullying, harassment, hazing, and/or intimidation. 


VALUES 

Values are beliefs and opinions that people hold regarding specific issues or ideas, and are ultimately internal, subjective, and malleable. They may change as demands or needs change. If a given belief or opinion is something that might be altered if the conditions are right, then it’s a value.

  • RESPECT- Treat others how you would like yourself to be treated. Speak and behave respectfully towards others.

  • TRUST- Trust goes both ways. It takes a lot of trust to allow someone to practice self defense techniques on you, but your partner is also trusting you to not do harm to them. Please practice safely together. 

  • CARE FOR OTHERS - Demonstrate concern for others. Never intentionally injure another student or engage in reckless behavior that might cause injury to self or others. Give help when needed.

  • SELF-CONTROL  -  Be aware of your actions and precision in training. Understand what is an appropriate level of force to apply.

  • INTEGRITY - Do the right thing. Be honest and truthful.

  • TEAMWORK/COMMUNITY- Do what is best for the community as a whole.

Legacy Filipino Martial Arts Code of Conduct

NOTE:  This is not intended to be an all-inclusive list of appropriate conduct but a sample list.  Refer to our Principles and Values to guide you in your behavior.

Respect your training partner and fellow members

  1. Always be respectful to everyone on and off the mat.

  2. Communicate with your partner/instructor the level of intensity you are comfortable training both as the attacker and defender when working on drills/ techniques & sparring.

  3. Communicate with your partner/instructor if they or someone is not exercising control with weapons/strikes/takedowns/locks. Protect yourself and your training partner.

  4. If you don’t feel comfortable with the material/partner/drill, feel free to take a break and simply observe off to the side.

  5. Understand that although this is a martial art school and getting hit is expected that everything should be conducted in a controlled manner.

  6. Always be courteous to your training partner before and after training.

  7. Do not hold any lock longer than necessary.

  8. Wear clean, dry clothing to class. Youth MUST be in uniform. When it comes to testing day, ALL Testers Adult and youth MUST be in full uniform. 

  9. Maintain your weapons by ensuring they are safe for training.

  10. Tape up your sticks if they are fraying.

  11. Ensure your training knives don’t have sharp edges.

  12. Check padded/sparring weapons before use for safety.

  13. Take turns practicing the techniques. As an example: Be the attacker 7 times and be the defender 7 times. Or whatever number you and your partner agree on.

  14. Come with an open/learning mind where we can learn from each other regardless of rank.

  15. Always strive to do your personal best.

Respect the training environment/space

  1. Keep all your belongings in the designated area and off the training floor.

  2. Always wear your shoes or flip flops when you walk off the mat.

  3. Do not step on the mat with shoes on. (Shoes made for mats or mat socks are ok).

  4. Make sure to keep your hands and feet clean before stepping on the mat.

  5. No shoes, food, gum, metal (zippers, metal knives) or drinks allowed on the mats. (Water is ok.)

  6. All jewelry and other loosely hanging items should be removed when training for safety.

Respect the School/Class

  1. Youth do not leave the mat during class without permission of the instructor.

  2. Talking should be kept to a minimum while the instructor is demonstrating the technique.

  3. If you do not understand the instructions, please ask.  You need to understand the technique before engaging with your partner.

  4. While instructions are being given sticks should be placed under the armpit with arms crossed. If holding knives, knives held in the right hand with the left hand grabbing the right wrist.

  5. Food is not allowed on the mats or during class time.

  6. Do not coach your children during kids class.

  7. All cell phones should be set to silent mode.

Respect yourself

  1. Know your limits and when to physically or verbally tap.

  2. If you don’t feel comfortable with a partner, technique, drill or exercise, feel free to stand aside until you feel prepared to rejoin the class.

  3. Keep fingernails and toenails trimmed and clean.

  4. Wash your hands after using the bathroom.

  5. If you sustain an injury, notify the instructor immediately. 

Respect the community

  1. As a representative of the Legacy FMA community, exercise proper conduct whether inside and outside of the school at all times.

  2. Look out for the wellbeing of your fellow students inside the school and outside.

  3. Do not come to class sick or with anything contagious.

  4. No cursing. 

  5. Shirts must always be worn inside the school. No training or walking around shirtless.



 

Legacy FMA Instructor’s Values

  1. Community: Legacy FMA Instructors/senior students shall reinforce the family spirit among members, parents, and other instructors. Their attitude must always be positive and cooperative, always putting the community in front of individual selfish needs.

  2. Cooperation: Legacy FMA Instructors/senior students shall nurture and reinforce a cooperative environment inside and outside the school.

  3. Respect: Legacy FMA Instructors/senior students shall reinforce that members must act with warmth and equality toward one another, regardless of their differences in race, creed, gender, nationality, etc. The ranks/hierarchy must be respected and the authority of the Guro Rank sincerely recognized.

  4. Leadership: Legacy FMA Instructors/senior students shall lead by example, kindness and care. The Instructor shall have a positive, cooperative, and constructive attitude towards the members and other instructors.

  5. Inspiration: Legacy FMA Instructors/senior students shall understand that they are role models and represent the school.

Conflict Resolution:

If at any time a member feels another member/instructor isn’t following the code of conduct or feels unsafe for whatever reason, please bring it up to our attention immediately. 


We encourage members to first talk with each other first (if comfortable doing so).  If you can’t work it out amongst yourselves, bring it to our attention.


Steps will be taken to ensure the matter is handled in a fair and just manner.

  1. Statements will be taken from parties involved concerning the issue at hand.

  2. Those statements will be reviewed by the senior instructors. 

  3. Witnesses, if any, will be interviewed and statements collected from them as well.

  4. Advisements will be made to both parties by the senior instructors.

  5. If a senior instructor is involved in the conflict or cannot be impartial for whatever reason that senior instructor will not be part of the conflict resolution process. 

  6. If no resolution has been made, a further investigation may happen, if possible. And will continue until the matter has been resolved.

  7. During this process both parties may be asked to discontinue training until a resolution has been made. 

  8. Files will be kept for future reference.


If any member/instructor has been deemed to be a safety concern to themself or to others, or has committed numerous offensive acts, they will be removed as a member and will no longer be part of Legacy Filipino Martial Arts. Severity of acts will be taken into consideration. If the act is majorly unsafe/offensive/uncalled for, that person will be removed immediately.


This document may evolve as needed as the years pass to be revised by the current roster of Guros who choose to help keep order in the community.
