In consideration of receiving instructions in the Martial Arts (Karate,Judo,Ju-Jitsu,Kung-Fu, etc.) and other physical cultures activities and being aware of the possibility of bodily injury, I hereby for myself, my heirs, executors, and administrators, waive and forebear to exercise any and all rights and claims for damages against Stonetown Karate Centre Inc., It’s officers, employees, instructors, or other representatives or members of it’s classes or organizations for all damages, injuries, or losses that I may sustain or incur, if any, while participating in activities or instructions sponsored completely or in part by Stonetone Karate Centre Inc..
In the event that emergency medical care is needed I hereby authorize it to be provided understanding full that any such care will be of the `First Aid` treatment type only.
I further consent that any pictures, movies, or video tapes whether from in person classes or virtual classes taken of me or furnished by me, can be used and reproduced by Stonetown Karate Centre Inc. for any legal purpose what so ever, without compensation to me. All negatives and positives, together with all prints shall constitute the Stonetown Karate Centre Inc.

PARTICIPATION AND WAIVER - Informed Consent
QUALIFIED HEALTH
Member/Parent/Guardian warrants and represents that he/she/Child is physically, mentally and emotionally fit to participate in the activities offered in this membership and that he/she/Child has no disability,impairment or ailment that would present a health risk as a result of such participation. If you have any injuries, physical limitations or any doubt as to your condition, you should consult your personal physician prior to engaging in these activities.
DISCLAIMER OF LIABILITY
Member/Parent/Guardian understands and acknowledges that there is inherent risk associated with many physical activities including the practice of Karate and other forms of self-defense. Member/Parent/Guardian voluntarily accepts these risks and acknowledges that the course consists of physical exercise and physical contact from which the member may suffer personal injury. The member/Parent/Guardian agrees to forever relieve and hold harmless Stonetown Karate Centre Inc., it’s Instructors, Members,customers and other participants from any and all liability or damages resulting from either personal injury or theft & loss of personal property whether or not due to the negligence of Stonetown Karate Centre Inc.
PERSONAL CONDUCT
In the practice of karate and/or kickboxing and other self-defense activities, personal conduct directly affects personal safety, the safety of other Members and the reputation of Karate Spirit. Members are required to conduct themselves in a manner that protects the safety of all participants and others at all times. Failure to do so is in violation of this agreement. Stonetown Karate Centre Inc. reserves the right to terminate membership for any reason whatsoever including behavior that is determined to be unacceptable.
OTHER TERMS
The member/Parent/Guardian acknowledges and agrees that the course will be given by Instructors of Stonetown Karate Centre Inc. and that no specific Instructor is guaranteed. The member agrees that any photographs/videos taken of them may be used for promotional/online purposes by Stonetown Karate Centre Inc. and that no compensation in any way will be received. The member/Parent/Guardian acknowledges that no oral or written representation has been made to them except as expressly recited in this contract. The member/Parent/Guardian agrees as a condition of this agreement never to teach, instruct, demonstrate, or exhibit karate, jujitsu, kickboxing or any other form, system or method of self-defense, Hand to Hand combat, Martial Art or Sport that is taught by Martial Art centres within a 25 km radius of any Martial Arts Centres or any other Academy, School, Club, or Studio directed, controlled by, or affiliated with Stonetown Karate Centre Inc. without the written consent of Stonetown Karate Centre Inc. within three (3) years immediately following the termination of this agreement. The member/Parent/Guardian agrees that Stonetown Karate Centre Inc. reserves the right to restrict, limit, eliminate, make additional or change any class or schedule as it deems necessary. The Member/Parent/Guardian agrees to transfer and to receive instructions at any other Stonetown Karate Centre Inc.location as so designated by Stonetown Karate Centre Inc. provided that any said Stonetown Karate Centre Inc. locations are within a twentyfive (25) kilometer radius of the customers home residence or business. The Member/Parent/Guardian agrees that any and all dishonoured payments made payable to Stonetown Karate Centre Inc. will result in an additional charge of $48.00 (fortyeight dollars) payable before class instructions can resume. The Member/Parent/Guardian may cancel this agreement without penalty at anytime within three (3) days of the date of this agreement by delivering written notice to Stonetown Karate Centre Inc. and that Stonetown Karate Centre Inc. shall refund any monies previously paid by the member/Parent/Guardian.
In the event of a government mandated shutdown of in person class instruction, classes will convert to virtual online live classes for students. No refunds will be given for paid programs and all monthly paid memberships will continue to be owed.
PROGRAM FEES
All paid in full program memberships (including 6 month, 1 year and 3 year programs) are fully transferable and NO refunds will be given at anytime. Members who upgrade to Elite or Master club will have their remaining balance of their existing program fee applied towards the upgrade program. All Belt testing/grading fees are not included in program fees and are payable at time of belt testing/grading. Transferred programs are transferred to new students only. The dollar amount remaining on existing members program will be transferred to the new student (not the time remaining on program). If a program is transferred before the end of the term any discounts options used to purchase the existing program will revert to the base fee (no discounts) when transferred. All Belt testing/grading fees are not included in program fees and are payable at time of belt testing/grading. Members/Parent/Gaurdian ackowledges that if at any time a membership is put on hold that payments continue until the membership/program term is completed and any paused membership time will be available for use.
