RELEASE AND WAIVER OF LIABILITY
I, the undersigned, hereby waive all claims against any and all persons associated with SIX BLADES JIU-JITSU FORT WORTH. I understand that the student above is participating in an activity which has body contact. I understand that Brazilian Jiu Jitsu, with or without the Kimono/Gi, involves chokeholds, arm locks, cranks, ankle/knee locks, throws, slams, and other activities that are excessively physical and may cause extreme pain or injuries. I assume full responsibility for all my actions while participating in any of the programs with SIX BLADES JIU-JITSU FORT WORTH. I understand the risk of participating in this form of training/martial arts and hereby release SIX BLADES JIU-JITSU FORT WORTH and all of its agents, employees and associates of and from any and all liability, claims, demands, actions, medical bills and causes of action whatsoever arising out of or relating to any negligent or other act or omission, and/or any loss, damage, or injury, including death, that may be sustained by the undersigned or any property of the undersigned in participating in this form of training. I, the undersigned, also state that the student is in good physical condition and know of no reason why I cannot train in this form of training. I have been advised that I should consult with a physician before participating in any physical conditioning or martial arts program. I understand that in case of emergency, I hereby authorize any licensed medical personnel to perform any medical assistance deemed necessary and I agree to bear the expense of any such treatment. As additional consideration for training at the SIX BLADES JIU-JITSU FORT WORTH, I agree that my attendance and or performance at the Academy and abroad at events may be photographed, filmed and/or taped and used by SIX BLADES JIU-JITSU FORT WORTH for marketing purposes and authorize the use of my image and I waive any compensation thereof-even if I discontinue my training at the SIX BLADES JIU-JITSU FORT WORTH. I acknowledge that I would like to receive correspondence from the Academy via telephone, mail, and email. I, the undersigned, being duly aware of the risks and hazards inherent upon participating in this form of training and martial arts, agree to all its rules, terms, and conditions. I knowledge that I have access to SIX BLADES JIU-JITSU FORT WORTH rules, have read them, understand them, and agreed to honor and obey them. I understand that disobeying the rules may, at instructors discretion, result in suspension or expulsion from SIX BLADES JIU-JITSU FORT WORTH and that I will not be entitled to a refund and if expelled must pay the remainder of my contract. In signing the foregoing release, the undersigned hereby acknowledges and represents that he/she has read the foregoing release, understands it and signs it voluntarily; that he/she is over 18 years of age and of sound mind. If under 18, a parent/legal guardian, in signing this release, agrees to all terms and conditions.
ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19
Because SIX BLADES JIU-JITSU FORT WORTH are open for business, I recognize that I might be at a higher risk for contracting COVID- 19. SIX BLADES JIU-JITSU FORT WORTH have put in place preventative measures to reduce the spread of COVID-19; however, it cannot be guaranteed that you will not become infected with COVID-19. Further, participating in the Martial Arts Program and/or being on the premises could increase your risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19, or infection may result in personal injury, illness, permanent disability, and death.
I understand the risk of becoming exposed to or infected by COVID-19 at SIX BLADES JIU-JITSU FORT WORTH may result from the actions, omissions, or negligence of myself and others, including, but not limited to: SIX BLADES JIU-JITSU FORT WORTH employees, individuals participating in the Martial Arts Program and/or their family members and agents of SIX BLADES JIU-JITSU FORT WORTH I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death) illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at SIX BLADES JIU-JITSU FORT WORTH participation in the Martial Arts Program. I hereby release, covenant not to sue, discharge, and hold harmless SIX BLADES JIU-JITSU FORT WORTH, it’s employees, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of SIX BLADES JIU-JITSU FORT WORTH, it’s employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any SIX BLADES JIU-JITSU FORT WORTH related program or activity occurring on SIX BLADES JIU-JITSU FORT WORTH premises.
I declare that I am not sick and not showing any COVID symptoms; I have not had contact with anyone who is sick or currently showing symptoms in the past 15 days.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY COERCION, INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY FROM SIX BLADES JIU-JITSU FORT WORTH TO THE FULLEST EXTENT PERMITTED BY LAW.
