INFINITE ATHLETICS: WAIVER, RELEASE, AND ACKNOWLEDGEMENT OF RISK
(Please read carefully and completely prior to signing)
In consideration of the services provided at Infinite Athletics, its owners, officers, employees, volunteers, participants and any other persons or entities acting in any capacity on their behalf. I hereby agree on behalf of myself, my heirs, executors, and administrators, to waive, release and forever discharge Infinite Athletics, LLC from all rights and claims for damages I may have as follows:
1. I acknowledge that participation in martial arts entails known and unanticipated risks, which could result in physical or emotional injury, temporary or permanent paralysis and/or even death. I understand that participation in such activity could cause damage to myself, to property, and or third parties. I promise to accept and assume, voluntarily, all the known and unknown dangers related to my participation in this activity, despite the risks due to intense, stressful, and strenuous exercises and body contact which include (but are not limited to) bruises, scratches, bloody noses, broken bones, heart attacks, and/or other cardiovascular diseases.
2. I certify that I have adequate medical insurance to cover any injury or damage I may cause and/or suffer. I further certify that I have no prior medical or physical conditions which could interfere with my safety in this activity, or else I am willing to assume and bear the costs of any, and all risks that may be created directly or indirectly by any such condition.
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless any owners or participants on the property located at Infinite Athletics LLC. from any, and all claims, demands and causes of action, which are in any way connected with my participation in this activity of my use of the equipment and or facilities located at 4220 W. Opportunity Way #103, Phoenix, AZ 85086.
4. Should any owner/Member of Infinite Athletics, LLC, or anyone acting on its behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to provide full restitution for all such fees and costs.
5. If I file a lawsuit against any owner or participant at Infinite Athletics, LLC, I agree to do so solely in the State of Arizona, and further agree the substantive law of the State shall apply in action without regard to the conflict of law rules of that State.
6. Photos and Filming may take place at Infinite Athletics, LLC, I willingly allow Infinite Athletics to use my likeness in any marketing, videos, pictures, and social media related to the Gym.
7. I, the undersigned am aware of the risks and hazards inherent upon participating in all activities provided at Infinite Athletics and agree to all its rules, terms, and conditions. I acknowledge that I have received a copy of the Infinite Athletics training rules, sparing rules, and etiquette, have read them, understand them, and agree to honor these terms.
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found in a court of law to have waived my rights to maintain a lawsuit against all owners and participants at Infinite Athletics, LLC based on any claim from which I have released them herein. I have had sufficient time and opportunity to read and understand this entire document, and I agree to be bound by its terms.
PARENT OR LEGAL GUARDIAN'S INDEMNIFICATION
(Must be completed for members who are participating under the age of 18)
I warrant and represent that I am the parent or legal guardian of in consideration of Minor's permitted by Infinite Athletics to participate in its activities and use of its equipment/facilities. I further agree to indemnify and hold Infinite Athletics, LLC from any, and all claims which are brought on by, or on behalf of ("Minor"), and are in any way connected with such use or participation by ("Minor").
